Terms and Conditions for BoomCast

Welcome to BoomCast. These Terms and Conditions ("Terms") govern your use of the BoomCast mobile application (the "App") operated by Boom & Bloom LLC ("we," "us," or "our").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Use of the Service
BoomCast provides a digital fishing guide, including Artificial Intelligence (AI) fish identification, weather and tide forecasts, digital logbooks, and tactical fishing information. The App is intended for recreational and informational purposes only.
2. Critical Safety Disclaimers (Please Read Carefully)
A. AI Identification & Toxicity Disclaimer
BoomCast utilizes third-party Artificial Intelligence (AI) to analyze images and descriptions to identify fish species. AI CAN MAKE MISTAKES. You must NEVER rely solely on this App to determine if a fish is safe to touch, handle, or consume. The App cannot guarantee the identification of venomous, poisonous, or dangerous marine life. Boom & Bloom LLC assumes no responsibility or liability for any injuries, medical emergencies, or damages resulting from handling or consuming fish identified by the App.
B. Weather, Tides & Boating Safety
The App provides marine weather forecasts, tide charts, and "Bite Scores" aggregated from third-party APIs. This data is predictive and may not reflect actual real-time conditions. You must always exercise personal judgment, check official maritime warnings, and prioritize your physical safety. Boom & Bloom LLC is not liable for any property damage, vessel loss, injury, or death resulting from decisions made based on the App's weather or tide data.
C. Fishing Regulations & Legal Compliance
While BoomCast provides summaries of local fishing regulations (e.g., size limits, bag limits), fishing laws change frequently and vary by exact location. The data in the App may not always be up-to-date. You are solely responsible for knowing and obeying all local, state, and federal fishing laws. Boom & Bloom LLC is not responsible for any fines, penalties, or legal actions taken against you by Game Wardens or wildlife authorities. Always verify current regulations with official state departments (e.g., TPWD, FWC, etc.).
3. Intellectual Property
All content within the App, including but not limited to the 3D knot animations, rig blueprints, UI/UX design, text, graphics, and the BoomCast logo, are the exclusive intellectual property of Boom & Bloom LLC. You may not copy, reproduce, distribute, or create derivative works from our content without explicit written permission.
4. User-Generated Content
When you upload photos or enter data into your personal Catch Logbook or Fish Library, you retain ownership of your content. By using the App's AI features, you agree that your image may be processed by third-party AI providers (e.g., Google Gemini) to provide the identification service.
5. Third-Party Services
The App utilizes third-party services (such as Google Firebase, Google AdMob, Open-Meteo, and AI providers). Your use of the App is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the availability, accuracy, or reliability of these external services.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Boom & Bloom LLC, its founders, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or personal injury, arising out of your access to or use of the App.
7. Changes to the Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice before any new terms take effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
